What would happen to the Presidential bid of Sen Grace Poe? Can Comelec disqualify her?

In two hours time, it is going to be Merry Christmas, at least for those who can afford to have noche buena. For 40% of the Philippine population, may be not so happy.  They can be happy by just being positive.

And for Sen Grace Poe who was "disqualified" from running as President;  it could not be any sadder. (Pero dapat naghintay pa siya ng isang term)

But legally speaking, and strictly speaking, she could not be disqualified by Comelec under Section 12 and 68 of the Election code but rather "petitioned to deny due course under Section 78.

This was stated earlier by former Comelec Commissioner and now retired Sixto Brilliantes in an interview with host Karen Davila at ANC.  (His position  though is seen as biased.  He is an election lawyer and is consulted by camps of Grace Poe and and Rodrigo Duterte, and is biased vs. Mar Roxas)

Only the Presidential Electoral Tribunal may disqualify Poe.   Comelec can not disqualify Sen Poe and under such conditions only as insanity (the lady from Iloilo maybe) incompetence, and conviction of a crime especially of rebellion, insurrection and the like

The issue of disqualification of Sen Poe is going to be long and complicated one.  As of the moment, the laws of Comelec and the opposing opinion may still favor Sen Poe.  The law may still favor her, if there is such thing as justice and fairness remaining in our govt system.

I think she should be given a chance to pursue her candidacy for President as she was granted that right as Senator.

  1. First and foremost, she should have been disqualified from running the senatorial position back in 2013 since there were already concerns about her citizenship. In my personal opinion, Poe should prove her abilities in the Senate before she haphazardly runs for the highest position of the land. She still has a lot of seeds to sow.

    We have a month to go before the campaign period formally starts, Comelec should urgently come up with the final decision on this issue. If she will be disqualified, her supporters will surely be dismayed. Nonetheless, it gives clarity to us, the voting public, on the country's stand on this pending issue - which should be better for the parties, and better for the Filipino people.

  2. I have to commend her for her composure though. Far contrast from the dutertes, roxases, and binays out there.
